2 63. After a month has elapsed from the date of the notice, should the
3 defendant not appear, the decree is carried into effect in the usual manner.
4 "64, All decrees against individuals who live within the jurisdictions of
5 the Sudder Moonsiffs are carried into effect by the Amildars under their
6 orders; the Amildars being invariably Executive Officers, excepting in
7 the’ towns of Bangalore and Mysore, where the Town: Moonsifis have
8 executive powers.
9 65. Sudder Moonsiffs, when the defendant’s property is beyond the
10 lintits of their jurisdiction, forward the application for-execution of the
11 decree through the Superintendent.
12 66. No decree is carried into effect, unless a special ape ieatiu to
13 that effect is made by the plaintiff.
14 67. When it becomes necessary to distrain the property of any indi-
15 viduals, the, Amil, -on being applied to, forwards a statement of the
16 defendant's property. This statement must be, duly attested by two
17 respectable merchants of the place. The Amil is held responsible for
18 its accusacy, and it must contain mention of any Circar balances due by
19 the individual; and then, should the amount not be paid within a cer-
20 tain time specified, the property, on a requisition from the Court, is sold
21 by public auction. The Government claim having first been made good,
22 the balance is appropriated to the adjustment of the decree.
23 68. The only articles of property exempt from distraint are the tools or
24 implements of the individual’s trade or calling, his wearing apparel, his
25 drinking lotah, and, if a ryot, grain for his subsistence until the next season.
26 69. " Concealment of property renders an individual liable to short-
27 Imprisonment and the property to seizure.
28 70. Should it be proved in the course of an inquiry, that the defend-
29 ant is disposing of, or making away with, his property clandestinely, or
30 that he is about to remove himself. beyond the jurisdiction of the Court,
31 the Judge can oblige him to give security for the amount claimed, or, if
32 he refuses, place him in close custody until it is given. This course of
33 proceeding however is adopted only on most reliable proof.
34 71. Should the defendant reside within the limits of the Company’s
35 Territory, the decree is carried into execution under the provisions of
36 Act XXXIII. of 1852.
37 72, All parties mutually consenting to adjust any differences (uncon-
38 ApusPunchayet or nected with Enamtee or Meerasee privileges) are per-
