1714. Umritsur and Lahore stand, as in last year’s report, at the head

Largest nuraber in Um. Of the list. It is to be remembered, however, that in these

ee ee districts a considerable proportion of the cases are of a

very petty character,—a large number as before observed being cases of

nuisance under Section 34 of the Police Act.

2215. Of the 735 persons under trial at the end of the year, 348 were in

Accused whother on bat: Custody, 160 on bail, and 227 on personal recognizance.

Reece The Deputy Commissioner of Kangra is inclined to doubt

whether bail is often taken under the provisions of Sections 212 and 249 of

the Code of Criminal Procedure in non-bailable cases, when the evidence

given in support of the accusation is, in the opinion of the Magistrate, not

such as to raise a strong presumption of the guilt of the accused person.

The point is not noticed by any other Deputy Commissioner, but Major

Cracroft is right in remarking that under the circumstances above set forth

the accused is entitled as of right and not as a favor to be admitted to bail.
