17 PART I.
18 1. (1) The provisions, so far as they can be made applicable in the circumstances for the time
19 being, and as amended for the time being by subsequent enactments, of the enactments specified in
20 the First Schedule to this Part, are hereby applied to the aforesaid tracts, subject, in the case of the
21 Code of Criminal Procedure and the Panjab Frontier Crimes Regulation, to the modifications speci-
22 fied in the Second Schedule to this Part.
23 (2) For the purpose of facilitating the application of the said enactments to the said tracts an
24 Magistrate or Court for those tracts may construe any provision in any such enactment with suc
25 alterations not affecting the substance as may be necessary or proper to adapt it to the matter before
26 the Magistrate or Court.

37 CRIMES REGULATION
38 (1) In the Code of Criminal Procedure—
39 (a) The Court of Session may take cognizance of any offence as a Court of original
40 jurisdiction without the accused person being committed to it by a Magistrate,
41 and shall, when so taking cognizance of any offence, follow the procedure
42 Hie a by the Code of Criminal Procedure for the trial of war:ant cases by

44 (5) No ann eal shall lie from any order of the Sessions Judge.
45 (c) Trials before the Court of Session may, in the discretion of the Sessions Judge, be
46 without jury or the aid of assessors.
47 (2) In the Panjab Frontier Crimes Regulation, 1887—
48 (a) For section 1, sub-sections (2), (3), (4), (5) and (6), the following shall be substituted,
49 namely :—
50 *©(2) This Regulation shall not be enforced against (1) European British subjects, or (2)
51 persons of any such class as the Local Government may, by notification in the official Gazette, de-
52 clare to be exempt therefrom, or (3) any person in the civil or military service of the Govéroment
53 unless such person is accused of having committed an offence conjointly with a persgn to whom this
54 Regulation applies.”
