5 Notification applying the Railways Act, 1X of 1890, and tssnuing orders thereunder.
6 and in connection therewith.
7 (?) No. 1328-]., dated the 23rd March, 1891.— Whereas the Governor General in Council has
8 and erercises full Jurisdiction within those portions of the land forming the Bangalore Branch
9 of the Madras Heateasy (including the land occupied by stutwns and out-buildings and for other
10 purposes connected with the Ruilway) which lie within the terrritories of His Highness the
11 Muahdrdjé of Mysore ;
12 And whereas the Chiefs of Morvi, Wankaner, Wadhwan, Lakhtar, Sayla, Muli, Dhrot
13 and Rajkot, and the Talukdars of Gavridad and Kotharia, in Kathiawar, have ceded to the
14 British Government the civil and criminal jurisdiction exercised by them within the lands
15 whioh lie within their respective territories and are occupied by the Morvi State Railway
16 (including the lands occupied by stations and out-buildings and forall other Railway purposes,
17 and the lunds occupied by culverts or bridges over uhich the Railway passes); and wh-reus the
18 Governor General in Council now possesses full jurisdiction within those lands ;
19 And whereas the Rulers or Administrators of the other States mentioned in the second column
20 of the schedule hereto annexed have ceded to the British Government full jurisdiction, or all the
21 jurisdiction they possessed, within the lands which lie within their respective territories, or which
22 hie within the parts of their respective territories mentioned or referred to in the third column of
23 the said schedule, and are occupied, or may be hereafter occupied, by the Railways mentioned
24 opposite their names, respectively, in the first column of the said schedule (including the lands
25 ocoupied by stations and out-buildings and for other Railway purposes); and whereas the
26 Governor-General in Council now possesses full jurisdiction within those lands:
27 In exervise of the jurisdiction referred to, and of the powers conferred by sections 4 and 5 of
28 the Foreign Jurisdiction and Extradition Act, XXI of 1879, and of all other powers enabling him
29 in this behalf, the Governor General in Council ia pleased to issue the following orders :—
30 I.——The provisions, so far as they may be suitable, and as amended for the time being by
31 subsequent enactments, of the Indian Railways Act, 1X of 1890, shall apply to all
32 the aforesnid lands.
33 ¥1.—In cxercise of the power conferred by section 16 of the said Indian Railways Act, the
34 Governor General in Council is pleased to sanction the use of locomotive engines or
35 other motive power, and rolling-stock to be drawn or propelled thereby, on all Rail-
36 ways occupying any of the aforesaid lands and for the time being used for the
37 public carriage of passengers, animals or goods,
38 I1].—The general rules for working open lines of Railway which were published under the
39 Notification of the Government of India in the Public Works Department, No. 299,
40 dated the 18th September 1880, in the Gazette of Indsa for 1880, Part I, page 450,
41 shall, subject to the modifications shown in the second column of the schedule annex-
42 ed to Public Works Department Resolution No. 467 R. T., dated the 15th August,
43 1890, published in the Gazette of India for 1890, Part I, page 647, apply to all Rail-
44 ways ovcupying any of the aforesaid lands, and for the time being used for the public
45 carriage of passengers, animals or goods.
46 1V.—The general rules for working Railways under construction and not used for the public
47 carriage of passengers, animals or goods, which were published under the Notification
48 of the Government of India in the Public Works Department, No. 4803, dated
49 the 30th October, 1890, in the Gazette of India for 1890, Part I, page 795, shall
50 apply to such portions of the Railways occupying any of the aforesaid lands as muy
51 for the time being be under construction.
52 V.—In exercises of the power conferred by seotion 144 of the said Indian Railways Act, the
53 Governor General in Council is pleased to delegate to Local Governments, to the
54 extent and subject to the conditions hereinafter specified, the following powers and
55 ftunctiona which are now vested in him under the said Act; the powers and functions
56 hereby delegated being liable to be revoked or varied, and the exercise and discharge
57 thereof to be controlled, as the Governor General in Council may from time to timy
58 think fit:—
59 (1) Sections 7,'3, and 11.—All the powers and functions of the Governor General
60 in Council, subject to the proviso that the exercise and discharge of such puw-
61 ers and functions will not entail any expenditure in excess of the geneial pow-
62 ers of sanction of the Local Government concerned.
