4 (2) Every Assistant to the Resident in Kashmir for the time being may exercise the powers of
5 a Court of Small Causes, with jurisdiction in all suits cognizable*under the Provincial Small Cause IX of 1887,
6 Couits Act, 1887, when the amount or value of the subject-m+tter does not exceed one thousand
7 rupees. 9
8 (3) Appeals shall lie, subject to the law for the time being in force, to the Resident in Kashmir
9 mon he decrees and ordeis of an Assistant, and the Resident shall exercise the powers of a
10 igh Court.

12 Laws.
13 (1) The provisions, so far as they can be made applicable in the circumstances for the time
14 being, and ns amended for the time heing by subsequent enactments, of the Acts specified in the
15 schedule to this notification, are, for the purposes of such cases as aforesaid, hereby applied to the
16 said territories.
17 _(2) Such portions of Foreign Department Notification No. 605-P., dated 28th March, 1873, as
18 are inconsistent with these orders, are hereby cancelled.

45 The existing arrangements for the exercise of jurisdiction in Kashmir may be summarised as
46 follows :-—
47 Criminal.
48 1. The Resident in Kashmir and his Assistants have powers for enquiry into or trial of cases
49 agaiust—
50 ‘ (a) European British subjects,
51 (5) Americans,
52 (c) Europeans of any nationality other than British,
53 (d@) Christians of European descent, : :
54 (ce) Native Indian subjects of Her Majesty, such Indian subjects being either merely
55 visiting the territories of His Highness or acting as servants of an European
56 British subject, or a) ;
57 (f) British subjects accused of having committed offences conjointly with European
58 British subjects.
