3 HIS, the Northern India Volume of the Lists of British Enactments in force
4 in Native States in India,(') contains all the information I have been able
5 to collect concerning the British Enactments in force in the Native States in
6 Bengal, Assam, Burma, the North-Western Provinces and the Panjab, the
7 Native States of Kashmir and Nepal and the Native States in Baluchistan.
8 2. The term “ British Enactments,” as used in this volume, includes—
9 (I) the Enactments made by the British Legislature in exercise of the
10 general jurisdiction which it possesses over its subjects and
11 servants in all Native States, and
12 (II) the Enactments made by or under the authority of the British
13 Indian Executive Government in exercise of the special juris.
14 diction which it has acquired, usually over all persons, in certain
15 Native States or places therein.
16 3. (*)The distinction between these two classes of Enactments has been
17 observed in classifying the British Enactments in force in the Native States
18 dealt with in this volume, the Enactments in force in each local area having
19 been placed under separate heads according as they belong to one or other
20 of these classes. Enactments which purport to be solely made under the
21 authority of the Legislature, or which appear to he limited to the classes of
22 persons with which the Legislature can deal, have been arranged under one
23 head and styled “ British-Indian Enactments ;”’ whilst Enactments which pur-
24 port to be made, in whole or in part, under the special authority of the Execu-
25 tive Government above described, or which do not appear to be limited to the
26 classes of persons with which the Legislature can deal, have been arranged
27 under a different head, having as its title the name of the particular place
28 for which the Enactments have been made with the word “ British” pre-
29 fixed(*). Broadly speaking, the “ British-Indian Enactments ”’ are personal. laws
30 applicable only to British subjects or servants, whilst the other Enactments are
31 territorial laws applicable to all persons in the particular places to which they
32 respectively refer.
