7 The Shan States.
8 Theee States, as being part of the territories formerly governed by King Thebaw, became part
9 of Her Majesty's dominions from the lst January, 1886 (see Proclamation of that date in Gazette
10 of India, 1886, Part I, page 1), and part of British India from the 26th February, 1886 (see
11 Notification No. 791-E., dated the 4th May, 1886, in sbid, Part I, page 311). They have been
12 dealt with by the British Legislature in the Upper Burma Laws Act, XX of 1886, sections 6, 7 and
13 8, and the Shan States Act, XV of 1888, and the Rules and Orders made thereunder.
14 The practical effect of these enactments has been generally to maintain the system of Native
15 administration which, on the annexation of Upper Baorma, the British Government found in ex-
16 istence in these States, the various Chiefs being vested (save in the case of the etty Chiefs in the
17 tract known as the Myelat, which is under more direct control), with the administration of civil and
18 criminal justice and the collection of the revenue within their States, under their own laws, subject
19 only to the control of the British Government. The criminal jurisdiction of the Chiefs does not,
20 however, extend to Europeans or Americans or Military Police-officers, or other servants of the
21 Government, or British subjects who are not natives of Shan States.

26 RULES AND ORDERS EELATING To THE SHAN SrarEs, 188UED SINCE THE 15TH JUNE, 1889.
27 Notification appointing the Superintendents and Assistant Superintendents, Shan States, to be
28 Ist class Magistrates and Justites of the Peace for certain States.
29 No. 6, dated the 1st August, 1889.—In continuation of Notifications Nos. 4 and 5, dated the
30 80th May 1889, (') and with reference to sections 46 and 47 of the Lower Burma Courts Act, 1889,
31 the Chief Commissioner of Burma, with the previous sanction of the Governor General in Council,
32 in pleased to appoint every European British subject, for the time being holding the office of Super-
33 intendent or Assistant Superintendent df the Northern Shan States, or of the Shan States, to be a
34 Magistrate of the first class and a Justice of the Peace within, aud for the whole of, the Shan
35 States, as defined in the Shan States Act, 1888, except the States of Momeik, Wuntho, Thaungthut,
36 Kale, Kantigyi, and Zingalein Kanti.

38 Notification extending portions of certain enactments with modifications to ali the Shan Slates.
39 No, 7, dated the 28th August, 1889.—In exercise of the powers conferred by section 8, subs
40 ecotion (1), of the Upper Burma Laws Act, XX of 1886, and by section 5 of the Shan States Act,
41 XV of 1888, the Chief Commissioner of Burma, with the previous sanction of the Governor General
42 in Council, is pleased to extend to all Shan States, for the time being notified under section 8, sub.
43 nection (3), of the said Upper Burma Laws Act, sections 14 and 19 of the Foreign J urisdiction and
44 Extradition Act, XXI of 1879, and so much of sections 16 to 18 (both inclusive) of the Act last
45 mentioned as have reference to section 14 of that Act.
46 2. The aforesaid portions of the Foreign Jurisdiction and Extradition Act, XXI of 1879, are
47 extended to the Shan States subject to the following modifications, namely, that the functions
48 assignable to, or exercisable by, a Magistrate thereunder shall be assigned to, or exercised by, the
49 lollowing persons :—
50 (a) The Superintendent or Agsistant Superintendent for the time being of the Northern Shan
51 States, as regards the Statea of North and South Theinni, Taungbaing, Thibaw,
52 Mainglén, Maingtdn, and Thénza;
53 (6) the ey oe for the time being of the Katha District, as regards the State

55 (c) the Deputy Commissioner for the time being of the Upper Chindwin District, as regards
56 the States of Kale and Thaungthut;
57 (d) the Deputy Commissioner for the time being of the Ruby Mines District, as regards
58 the State of Momeik; and
59 (¢) the Superintendent or Assistant Snperintendent for the time being of the Shan States,
60 as regarda oll other Shan States.
