3 the goods through the possessions of one who
4 has the power to protect, and the inclination to
5 encourage, the transit of traffic through his do-
6 mains. *
7 The revenue is in too many instances collected
8 VI et armisy and sometimes falls short of the amount
9 estimated above, for the tribes residing in the
10 vicinity of the mountains, especially those called
11 the Yousuffzyes (who have never been properly
12 and entirely subdued), often succeed in resisting
13 payment by flying to their fastnesses, carrying
14 with them everything of the smallest value, and
15 there defying the pursuit of the soldiery. As a
16 consequence of a frequent deficiency of revenue,
17 arrears and irregularity distinguish the adjust-
18 ment of the accounts in every department of the
19 state.
20 The exercise by the chiefs of the office of judge
21 in all civil and criminal cases dispenses with the
22 establishment of regular courts of law. Custom
23 and caprice, therefore, are substituted for the lex
24 scriptUy and much injustice is necessarily the re-
25 sult. As there is a strong disinclination to inflict
26 capital punishment, crimes and trespasses are
27 generally atoned for by fines, levied according to
28 the means of the offender, whose property is
