24 2. In exercising the piers conferred by this Notification the Deputy Commissioner shall observe
25 the aarotd prescribed for Magistrates by the Code of Criminal Procedure, 1882, as modified by
26 the Upper Burma Criminal Justice Regulation, VII of 1886.

28 Notification modifying the customary law of all the Shan States, except the Myelat,as to capital
29 sentences.
30 No 10, dated the 5th September, 1889.—In exercise of the power conferred by section 4, sub-
31 nection (7), clause (d), of the Shan States Act, 1888, the Chief Commissioner is pleased to make
32 the following orders modifying the customary law of all the Shan Statea, except the States known
33 an the Myelat, where criminal jurisdiction is vested only in the Magistrates and Judges appointed
34 by the Government :—
35 1 No capital sentence shall be executed except by the explicit order of the Chief of the State
36 in which the offence, in respect of which the sentence is passed, was committed.
37 2. In any cnse in which the accnsed is liable on conviction to capital punishment, the official
38 conducting the trial shall examine the witnesses for the prosecution and for the defence (if any) in
39 the presence of the accused, shall give the accused an opportunity of defending himself, and shall
40 record a proceeding embodying the finding and sentence, and the reasons therefor.

42 Notification rectifying the Boundaries of the State of Mometk.
43 No. 11, dated the 1st October, 1889,—In exercise of the powers conferred by section 3, clause (a),
44 and section 8, aub-section (3), of the Uppor Burma Laws Act, 1886, the Chief Commissioner, with
45 the previous sanction of the Governor General in Council, is pleased to direct that the circlea or
46 kayaings of Twinnge and Daungboungaywa, comprising the local area included in the boundaries
47 specified below, shall, with effect from the date of this notification, cease to be a part of the terri-
48 tories constituting the Shan State of Momeik, and shall be udded to, and form a part of, the Ruby
49 Mines district :—
50 Boundaries.
51 North.—Tho Shwelaungchaung, from its mouth to a point about 10 miles eastward.
52 South.—The Udaungchaung, from its mouth to the Yegyotaungdan, approximately 15 miles
53 from the Irrawaddy river.
54 East.—From the Shwelaungchaung, a line running southward along the ridges known as Letha-
55 daung and Yegyotanungdan to the eastern limit of the southern boundary on the
56 Udaungchaung.
57 West —The Irrawaddy river.

59 Notification extending certain portions of the Code of Criminal Procedure and the Upper Burma
60 Criminal Justice Regulation to the Myelat.
61 (")No. 13, dated the 28th November, 1889.—Under section 8, sub-section (1), of the Upper Burma
62 Laws Act, 1886, the Chief Commissioner of Burma is pleaxed, with the previous sanction of the
63 Governor General in Council, to extend so much of the Code of Criminal Procedure and of the Upper
64 Burma Criminal Justice Regulation as is in force in any part of Upper Burma at the date of this
65 notification to the tract known as the Myelat and comprising the States of Ywangan, Kyauk-
66 kuleywa, Pwebla, Pindaya, Bawzaing, Kyén, Nankén, Thamaingkan (inclnding the old States of
67 Magwe, Lwa-an, Taunghla and Myinmati), Pinbmi, Lwa-2, Lwémaw, Nanke, Nantdk, Lwélén and
68 Sagwé.
69 {I. From the dete of this notification so much of Notification No. 1, dated the 4th March,
70 1889,(7) published in the Bussna Gazette of the 9th March, 1889, Part I, page 98, as extended so
71 much of the Code of Criminal Procedure and of the Upper Burma Criminal Justice Regulation as
72 was in force in any pait of Upper Burma at the date of that notification, and had reference to the
73 judicial functions of Magistiates of the first class and of District Magistrates either as such, or as
74 Judges of Courts of Session, is hereby superseded.
